Section 1. The executive law is hereby amended by adding
thereto a new section, to be section eight hundred four-a, to
read as follows:

§ 804-a. Special power of the agency; reservoirs; certain
cases. Notwithstanding any inconsistent provision of this article
or other law, the agency shall exercise the same powers, functions
and duties with respect to any proposed alteration of any lake,
pond, river or stream for the purpose of creating or enlarging a
reservoir in'any area subject to the agency's jurisdiction that
it is empowered to exercise with respect to any new land use or
“development or new land use.
§ 2. This act shall take effect immediately.
