Childers, a 32-year-old black,man, lived on Reno St., Philadelphia,
Pa, Around 9:30 on the evening of March 25, 192, he entered the
small grocery store owned and operated by 5 eeveareold Joseph Dow-
shen at 595 Race Street, At the time, Mr. Dowshen and:his family
were in the upstairs living ouarters and Childers went to the cash
register, opened it and began taking money, Mr. Dowshen heard the
register open and came downstairs to be confronted by Childers who
was holding a pistol and informed him that it was a holdup, Dow-
shen continued coming towards him and Childers fired, hitting him
in the abdomen and inflicting a wound from which he died shortly
after being taken to a Philadelphia hospital. Childers was over-
powered by Dowshen's 25-year-old son who had followed his father
downstairs and some passers-by who had heard the shot.a He did not
take the stand at his trial and he was convicted and sentenced to
die, The only defense that had been offered in the trial was the
testimony of two witnesses who said that prior to his arrest for
