the police and when they arrived, Hathaway was standing as though in a
stupor, At his first trial, he pleaded guilty but the jury was unable
to agree on a penalty with eleven members voting to hang him and one
insisting on life imprisonment, A new trial was ordered and Hathaway
pleaded not guilty and offered a defense of insanity but was convicted
and sentenced to die by a jury which deliberated for only eight min-
utes. His case was unsuccessfully appealed to the Kentucky Court of

_ Appeals and he was hanged in the midst of falling snow behind an en-
closure in the jail yard at Winchester on January 3, 1905, Sixty
persons witnessed the execution and Hathaway went to his death calmly
and making no final statement.. His neck was broken by the fall and

HATHAWAY, John E,

Hathaway, a 26-year-old black man, had, at one time,been one of the
leading jockeys in Kentucky, having ridden many outstanding thorough-
breds to victory during his career, After he retired from the track,
he obtained employment as a waiter in a hotel in Jackson, Kentucky,
and entered into a common-law relationship with Etta Thomas, Hathaway
became jealous of the girl and when she announced her int entions of ior
leaving him, he opened her trunk and cut all of her clothing to pieces
Miss Thomas then went to Winchester where she entered a house of pros-
titution operated by a woman named Alice Bean, Rathaway made a number
of attempts to discover her whereabouts and finally another man told
him that he had seen her in Winchester, , He went there and when he
learned her address, he sent a friend to ask that she see him, , Both
she and Miss Bean were frightened of him and refused to ask him over,
He then went to the house himself and, after emptying his pockets to
show them that he was unarmed, he told then that he had come to remn-
erate her for the destroyed clothing and was allowed inside, They
talkefl for some time, with him begging her to return to him and her
refusing. Finally, she told bhm that she had a white boyfriend and

would never again live with another black man, Hathaway then drew a
pistol that he had consealed in his prousers and shot her, After she

had fallen to the floor and while she was begging for her life, he
