Carter, .a 22-year-old white man, was a resident of Middletown, BVe LH
192 he had committed a number of armed robberies in various business
establishments in Hamilton County, Ohio, and, at the urging of uneasy
merchants, the police staked out a number of places where they felt
the unknown bandit would strike, On the night of July 8, 1912, he
entered a drug store located on the corner of Courtland and Franklin
Avenues in Norwaod and, at the point of a pistol, demanded and re-
ceived the contents of the cash register, When he demanded more money,
the owner told him that the remainder was in a back room where Police
Sergeant Anthony H, Overburg was staked out, As they entered the
room, Overburg placed his gun at Carter's side and disarmed him, They
were walking out of the front door when Carter unexpectedly whirled
and snatched Overburg's weapon from him, In the struggle that follow-
ed, Overburg was shot three times and fatally wounded, Carter managed

he remained at large until January, 199, when, following a tip re-
ceived from a former girl friend he was taken into custody at the
