PASQUALE, Frank J,

Pasquale, a 28-year-old white man of Italian descent, was a laborer
in $acoma, Washe, where he took out an accident insurance policy with
Charles Gray, an insurance salesman, Early in 190), while at work on
the city streets, he was struck by a street car and unconscious for
several hours, remaining in the hospital for 17 days. During this
time, Gray visited him at the hospital and told him that his premiums
were three days overdue and had him sign a paper which Pasquale subses
quently claimed that he did not understand, After his release, he
felt that Gray owed him $5) which Gray refused to pay. They quarreled
frequently over the matter but on May 20, 190), they seemed to have
resolved their differences and Pasquale agreed to accompany him to a
railroad car in which some Italian railroad laborers were living to
assist him in sebling them insurance, As they were walking across
the tracks, Pasquale pulled a revolver and shot Gray through the
head twice, killing him instantly. Some workmen saw the shooting
and when RAXQHAXK Pasquale saw them running towards him, he fled and
escaped, He was captured three days later near Ravensdale and re-
turned to Tacoma where he was indicted for the mrder. His defense
was one of insanity brought about through repeated HHKXK epileptic
