HARVEY, Smith
Harvey, a 40-year-old black man; was a native of Lady's Island, Beau-
fort Cos, S. C. He served in the U. S. Army amxifor three years dur-
ing World War II and became an expert marksman, After his discharge,
he returned to Lady's Island and began attending a school’ about eight
miles away mmuxkhw under the G. I, Bill of Rights. On the night of
Feb. 17, 1951, he had been out attempting to pawn a loaded .|5 calibre
pistol. When he was returning home, he passed an automobile parked
about one-half mile from his house in which Aubrey Godley, Lonnie God-=
ley, Wilson lee McAlhanéy and one other white men who had been drinking
were parked and singing, Harvey said that when he passed the men had
called him a "Nigger" and asked where they could obtain some black wo-=
men for sexual purposes. When he had asked them not to call him "Nig-
ger," the two Godleys and McAlhaney got out of the car and started
towards him. He shot mix and killed all three of them, firing the
fatal shots into Aubrey Bodley's back as he EXSHIBAXHHR fried to
crawl under the front of the car for protection. The fourth man who
had lain down in the seat of the car was ia auzed and promptly
