| ferior Court of this county, a case of considerable novel-
ty, in this part of the country, has been decided, Thomas
Franklin Hall, who now lies under sentence of death, for
the murder of a negro belonging to John P. Williamson, in
December last, was sued for trespass, at the instance of
the owner, We learn that the plea set up by the defend-
ant's counsel, was, that Hall being capitally convicted,
was CIVILITER MORTUUS, and that the private injury was
merged in the offence committed against the public; to
which it was replied, that his appearance before the Court,

by his attorney, invalidated this pleas and again, that the
doctrine of Merger was inapplicable to this institutions of
this country, putting out of view the fact, that the Englis
law meant to create a disability and not to invest the de~
