and was returning home when McCarty met her, knocked her
down, choked and ravished her, ‘t trial she positively
identified, When arrested several days after crime, made
a statement admitting guilt, He testified in own behalf,

repudiating confession which he said was beaten and forced
by officers.

“Huntsville, Texas, July 9, 1937=Earnest McCarty (20),

Fort Worth negro, was electrocuted in the state prison here
early today for assault on a white woman, Ina last state-
ment he denied he was guilty. Scared but with a half-smile
on his face, the negro walked from death row into the exe-
cution chamber one minute past midnight. The negro waved
his hand at the roomful of witnesses, ‘Have you anything
to say?! Warden WW. W. Waid asked him, (No more,' said the
negro formally, ‘than that I am not guilty of the crime I
