Crummins, ;the white owner of a saloon located at 23 Pell St., New
York City’s and a man named Dennis McHenry had quarreled over money
matters, Crummins had also accused MeHenry of having made some in-
sulting remarks about his wife, On the night of Oct, 10, 1857,
MeHenry and two campanions entered the saloon while Crummins was out

drinks and waited, When Crummins entered and saw McHenry, he immed-
