visited by his father and two brothers before his execution, requeste
no special last meal and ate a bacon and tomato sandwich and drank
coffee and lemonade, He went to his death calmly and when he objected
to being accompnied by a minister, saying: "I came in by myself and
I'll go out by myself," the minister followed behind him,

Davis, a 22-year-old black man, was a resident of Cleveland, Ohio,

who had served in the U, S, Army during World War II, His sister,
Eleanor, had been emloyed as a maid in a house located AXX at 2580
Colchester Road, Cleveland Heights, and, after she had been dis-
charged, Davis who had managed to obtain a duplicate to the key for
the front door, decided to burglarize the residence, On the night
that he attempted to gain entry through the front door, his key
failed to KK open it and he shot the lock from the door, This
aroused the sister-in-law of the owner and the current maid and he
terrorized them, threatening them with the pistol, while he ransacked
the house, gathering up a quantity of costume jewelry and other trin-
ketse A neighbor had also been arousedand she summoned the police,
Rookie Patrolman Norman C, Reker and his partner arrived a few minutes
later and, as Reker bounded up the front steps, Davis shot him in the
abdomen, inflicting a fatal wound, Reker and his partner returned the
fire and Davis was struck six times, his most severe wound being a
severed artery in one of his legs from which he almost lost the use of
a foot, At the hospital he was told that Reker was dead and his reply
was: "is he dead? Good, I'm not sorry I killed him, I'd kill any
copy if I got a chance," At his trial, his defense was one of intoxi-
cation and insanity and his attorneys presented alienists who testifies
