Gardner, a white farmer, was born in Massachusetts in 1793 and moved
to Ohio in 1813, finally settling in Gustavus Township, Trumbull Co,
In Ellsworth, Ohio, he had married a widow, Ann Logan, and when they
moved. to Gustavus, they were accompanied by Mrs. Gardner's daughter,
Anna Maria Buell. In early August, 1832, Miss Buell, then l6é-years~
old, ran from her stepfather's home with her clothing disarrayed and
claimed that he had attempted to assault her. She refused to return
home and moved in with some neighbors, Gardmer finally persuaded her
to return for her clothing and on the afternoon of August 8 she went
home for the sole purpose of obtaining her belongings. In the pre~
sence of his wife, a neighbor and two passers-by, Gardner stabbed the
girl twice in the abdomen with a butcher knife, killing her instantly.
He was promptly taken into custody and at his trial before two gus-
tices of the Ohio Supreme Court he was convicted and sentenced to
hang. The Governor was presented with a petition signed by a number
of the leading citizens of Trumbull County requesting that Gardner's
sentence be commuted to life imprisonment and a granted a reprieve
