Martin, a 2Q-year-old black man, lived with his parents in a rural
section of Frederick Co,, Md. Between 1 and 2 o'clock on the morn-
ing of April 6, 1870, he slipped out of the house and went to the
home of an aged white couple, Mr, and Mrs, Butcher, who lived near-
by, admitting himself through a rear room window. He then went
into the bedroom where Mr, Butcher, 100-years-old, lay sleeping
with his 82-year-old wife. While the old man lay helpless in the
bed beside her, Martin raped the wife, He then returned home and
went back to bed where his mother found him when she summoned him
for breakfast, Speedily captured, Martin maintained his innocence
‘even though the Butchers adentified him as the rapist, Convicted
and sentenced to die, he made a partial confession on the Monday
preceding his Friday execution, admitting that he had gone into

the Butcher house but denging that he had raped Mrs. Butcher as
