Howard, a 37-year-old native of Iudinois, was a deputy constable
Tulare, Calif n-the evening of June 16, 189), he had been drink-
ing all of the day and he went to a boarding house in one of the
more disreputable sections of Tulare where Martini de la Nina, an
Italian, lived with his common-law wife, Howard and de 1a Nina
ue been on friendly terms and, earlier in the day, de la Nina had

Once again Howard asked de la Nina for money to.buy.more wine. The
Italian explained that he did not have any more money and could not
lend him any. They argued for a few minutes behind the boarding
house and de la Nina turned his back on Howard to walk away, At
that time, Howard drew a pistol and shot him in the back, killing
him instantly. He was taken into custody a few minutes later and
seemed agreived when aprised of the fact - that he ome be. placed.
