DeBerry, a el-year-old black Army Private, was stationed at Fort Knox,
Ky. He entered into a conspiraéy with five other blacks, 2l-year-~old
Burney Davis; 2-year-old Willie Childress, 37-year-old Curtis Lee
Coleman, h9~year-old John Lancaster and 2-year-old Nelson Meilroy,
to break into the River Road Country “lub near Louisville and steal
the contents of’ the safe, On the night of Jan. 2, 1955, they met
and formalized their plans with Coleman, a former employee of the —
Clubs; providing a layout and the usual schedule of the watchman,
Richard VY, Eddins, Lancaster drove, Coleman served as the lookout
and McKlroy, the safecracker waited outside until all was ready while
the other three men entered the club. When they heard Eddis approach-
ing, they hid in the women's locker room where they were discovered,
iddins was unarmed when he entered the room and De Berry shot him
three times and killed him, DeBerry was the last of the six to be
taken into custody when he was arrested at San Antonio, TeXey where
he had been transferred by the Army. Prior to his trial, he made two
confessions in which he admitted that he had shot Eddins, but at his
trial he repudiated them and claimed that he was high from sniffing
