of Berkeley, near Mr. Robert Rutherford's Mill,
on 8 poor laboring man of the name of Johnstone

stone's house, used abusive language to John-
stone's wife. McCabe drew 4 pistol...which
McCabe instantly discharged,..the deceaséd ex-
pired in a few minutes. McCabe...re-loaded Kis
