Scott, a white man,was born in Indiana in 1837, During the Civil War
he served for four years in the Union Army as a member of the Third
infantry Regiment and after the war he and his wife moved to Granite,
Deer Lodge Co,, Montana, where he worked as a woodchopper, Scott was
an alcoholic who periodically went on prohonged drunken sprees during
which he would accuse his wife, Matilda, of infidelity and beat and
otherwise mistreat her, Late on the night of Nov, 16, 1887, he re-
turned home intoxicated and they got into an argument during the
course of which he bludgeoned her to death with his Winchester rifle,
The next morning when neighbors were unable to arouse them, they
forced entry into the house and found her body weltering in its blood
and him lying nearby in a drunken stupor, After he had been placed
under arrest, officers started with him on the train for Beer Lodge,
A mounted body of forty armed men followed, determined to overtake
the train a Drummond and lynch him but the train dispatcher learned
of the plot and provided the officers with a special locomotive
which took Scott directly to Deer Lodge where he was placed in the
county jail, At his trial he claimed that when he returned home he
found another, man named Beach there and that he was #N struck on the
