Small, a white man, lived in Pittsburgh, Pa., where he was friendly
with C. Re "Nick" Jacoby and Jacoby's wife, Small was having an
affair with Mrs, Jacoby and on the night of Jan, 16, 1879, he and
the Jacoby's were in a back room of Kaiser's saloon when the pro-
prietor heard a noise and went back to investigate. He found
Small and Jacoby suffling and ordered them all to leave, Later
that evening as Jacoby and his wife were out walking, he was shot
and fatally wounded. Before he died, when asked who had shot him,
he replied that whatever his wife said would be the truth and she
was taken to police headquarters where she finally named Small as
the killer, In spite of his denials, he was arrested and charged
with the murder. Convicted and Sentenced to die, he was hanged in
the jall at Pittsburgh on Maych 2h, 1882, He continued to deny his
guilt and his last words were: "TI cannot say anything except that
I am not guilty, as this crowd has knocked the wind out of me, I
want this to be done as soon as possible, I did not kill Jacoby, "
