Hauer, a wyoung white man, was a native of Pennsylvania of German des-
cent. He was married to Elizabeth Shitz, the daugher of a prosperous
German of Heidelberg Township who died in Thos, By the terms of his
will, Elizabeth received 1,000 pounds from which was deducted money
that had already been advanced to her. The remainder of his estate
went to his two sons, 2l-year-old Francis, and 18-year-old Peter,
Hauer was dissatisfied and tried to contest the will, He then withdre
the suit and attempted to persuade the brothers to divide equally with
their sisters, telling them on one occasion that their Father's ghost
had visited him and told him that he could not rest easily until this
was done, When the brothers refused, Hauer made several. abortive
attempts to kill them, on one occasion attempting to poison the entire
Shitz household, He then enlisted the aid of Charles McManus, a young
Irishman, promising him 1100 pounds if he would assist, him in killing
the brothers, Mrs, Hauer and three other Iréshmen, Peter McDonogpy,
Patrick Donagan and Francis Cox also had knowledge of the plot and
were used to provide alibis for Hauer and McManus, On the night of

December 28, 1797, a maid in the Shitz home heard ama@ noise in the
