Rose, a 27-year-old white man, was serving sentences totalling..eight
years on the Dougherty Co., Ga., chain gang foblowing his. conviction
in that county on Sept. 23, 1936, of attempted robbery, pointing.a.
pistol and assault and battery. In December, 1936, he and another’
prisoner, Fred MiéMichen who was erving a sentence on A misdemeanor,
atvempted to escape and Rose killed one of the guards, Tom Lewis,
Both he and McMichen were charged with the murder and McMichen re~
ceived a life sentence while Rose who had actually killed Lewin was
sentenced to die. His request for a new trial was refused by the
