Henderson, a mulatto native of Annapolis, Md., was a barber who
had served with distinction in both Cuba and the Philippines af
during the Spanish-American War, Afterwards, he established a
common=Law relationship with a woman named Ida McCormack who subse-
quently was known as Mrs..Henderson. They moved to Duiuth, Mim.,
where Henderson obtained employment and they shared an apartment
with another couple. Their rela tionship became strained, there
were frequent quarrels and, after Henderson had thrown her on a
bed and attempted to choke her, she moved from the apartment and
obtained lodgings elsewhere, She also started courting another
man which infuriated Henderson. On June 21, 1902, he slipped into
her apartment and hid in a closet where he overheard a conversa-
tion between her and another woman in which Miss McCormack reveal~
ed the fact that she and Henderson were not legally married and
stated that she had gone to the police and asked from protection
