Smith, a ll-yeareold black man, was employed as a handyman in a House
ton, Texas, country club, He purchased a pistol with the intention,
so he said in his confession, of robbing some place of business, On
July 26, 1958, he entered the grocery store owned and operated by two
young Chinamen, one of whom was T, H. (Hack) Wong, and after deciding
that it would be an easy place to rob, he went home, changed clothing
and armed himself, When he returned, he shopped and loaded up a bas~
ket with groceries until everyone was out of the store except Wong
who was running the register, When Wong had totaled up the groceries
and presented him with his bill, Smith drew the revolver and told
him that he wanted money, ‘Wong told him to stopm kidding and Smith
pushed him backwards and shot him, inflicting a wound from which Wong
subsequently died, His conviction and the sentence of death were
affirmed on appeal and he was electrocuted at the Texas State Prison
on August l, 1959. Prior to his death he told a reporter from his
death cell that two other men had provided him with a pistol and
