Chavez, a 25-year-old Mexican national, was employed as an irriga-
tor on a farm near Colusa, Calif, As his work visa had expired, he
was in the United States illegally. He fell in love with 30-yéar~
old Connie Novarro, the operator of a restaurant-bar in Colusa,’ but
she rejected his overtures, Though he did not ordinarily drink, he
spent Saturday evening, July 22, 1950, drinking in severdl Colusa
bars including the one run by Mrse Novarrog Around |; o'clock the
next morning, he entered her apartment at 635 Main Street and raped
her at knife point. A waitress from the restaurant who roomed there
heard the commotion and entered the room as Chavez was finishing
