Even though he did not offer insanity as a defense, this was his con-
tention at his trial which began on April 29, It took six days to
impanel a jury and the trial lasted for eight more days. Garlitz's
defense was largely discredited when it was shown that he himself

was guilty of sexual intimacies with several other women after his
marriage and that he had refused to support his wife and child and

he was convicted by a jury which deliberated for only two hours, His
conviction was affirmed by the Gourt of Appeals and when he was resen-
tenced to be hang, he showed his first emotion since his arrest when
he broke down and wept bitterly, His requests that he be allowed to
see his child and that he be buried by the body of his wife were both

1889, he was hanged in the jail yard at Cumberland, After eating a
hearty breakfast, he went to the gallows calmly and made no statement,

Garlitz, the son of former Sheriff Basil Garlitz of Alleganey Co,,
Mdey was a 25-year-old white employee of various railroads, On Jane
21, 1885, he and B Leah Eva White, the daughter of a Cumberland
commission merchant eloped and went to Gretna Green, Pae,y where they
were married, They returned to Cumberland but their marriage was not
a happy one and, in time, she returned to the home of her father where
a child was born, The estranged couple frequently met clandestinely
because of her family's determination to keep them apart, and on such
meetings they frequently quarreled, On March 23, in the presente of
her sister who frequently accompanied her to their meetings, Garlitz
drew a knife and threatened to kill her, The next day she and her
sister took her child to the home of Garlitz's brother and they met
again, On Tuesday, March 26, she received a note from him asking
that she meet him on a Cumberland Street. Once again, she was accom-
. panied by her sister, but she and Garlitz walked off together after
they met, After accusing her of infidelity with another man, which
