Cody, alias Fred Yerdlow, was agwhite man who worked on a farm in
WauX Malheur County, Ore, On August 2h, 192), he and a fellow worker
stopped overnight at thehome of a rancher in Harney County and the
next morning purchased two geldings for which Cody gave a check
signed with his alias on a bank in Nevada, The rancher had his bank
in Burns to wire the bank in Nevada and was notified that the check
was worthless, He had a warrant issued for Cody's arrest and. Austin
Goodman, the Sheriff of MAX Harney County, was notified that the
warrant had been issued by telephone though he did not have it in
his possession. On August 27 he went to the farm where Mody worked
and told him that he was under arrest, Cody asked to see the
warrant and Goodman explained that he had been notified by telephone
of its issuance. Cody appeared to assent to accompany theSheriff
but asked that he be allowed to get his saddle and bridte, The
Sheriff assented to the request and when he reached his horse, Cody
drew his rifle and shot the Sheriff who was hit in the leg with the

bullett severing an Ae from which he bled to death in a short
