the identification by his witness, a strong circumstantial case was

VAUGHN, Willie

Vaughn, a 22@year=old black man, lived in San Antonio, Texe, where he
had been arrested on suspicion in the rape of a Mexican girl in 1923,
Enough evidence to charge him formally with the crime could not be
gathered and he was released from custody, On April 21, 192, he was
arrested, charged with and indicted for the rape,of an 18«year-old
black girl and released on bond pending his trial, Early on the morn-
ing of Dec, 8, 192), he waylaid a 19-year-old white girl who was walk-
ing through Madison Souare Park to.attend early morning mass at the
Ursilene Convent and dragged her about 75 feet from the center of the
park to:some shrubbery near an old tool shed, The girl offered him
the money that»she was carrying in her purse.and when she resisted

his attemptxto rape her, he choked her into unconsciousness, assaulted
her and fled, After she had recovered, she began screaming and some
other persons, summoned by her cried, appeared and took her to a hos-
pital, Vaughn was arrested the next day and identified by the girl

as well as by other witnesses who saw him fleeing from the park after
the attack, He sought to prove an alibi, claiming that he was out

drinking with another man and two women and that he had gone home
