Fain, a 26-year-old Negro mechanic, had served a prison term in Nort
Carolina for the attempted rape of a Negro woman at Murphy and one
in Georgia for attempting to enter the home of a white woman at

Blue Ridge, Ga. On Jan. 29, 1939, he was employed at a garage near
Whitfield Hospital in Murphy. Around three o'clock that morning, he
entered the hospital room occupied by Mrs, Frank Kilpatrick who had
just given birth to a child. He bound Mrs. Kilpatrick and her l5-
year-old nurse WHA with gauze and then raped the nurse, Afterwards,
he took about $90.00 SEMKXMXESXKIIQEXEXEKNIE and two rings from Mrs,
Kilpatrick's purse and left. Fain, who had covered his face with a
towel, was suspected when he did not arrive to work and he was
followed to Atlanta, Ga,, and then to Maryville, Temn., where he was
captured six days later. Fain confessed the crime and both rings
were recovered. He was held in the Ashville jail for safekeeping
and returned to Murphy for his trial where he was convicted of rape

and Burglary, both of which carried the death penalty. Fain was
executed in North Carolina's gas chamber on Oct. 6, 1939.
