Grogans, a burly 33-year-old black man, lived in Beaumont, Jefferson
Co. Tex. QKXEMEXKZEMKXARXLHX Around 8 o'clock on the night of July
el, 1231, he approached a car parked on a muddy road located on the
outskirts of the city in which a young white woman and her escort
were parked, Using force and threatening with the shotgun which he
was carrying, he raped the woman, After his arrest, he was positive-
ly identified by byth her and her escort, His defense was that he
had loaned the gun to another man who had returned it late on the
night of the rape and he attempted to fix blame for the assault on
him, However, the other man was able to prove an alibi with.wit-
nesses and he testified that he had never borrowed the gun, Grogans
also sought to prove an alibi for himself by a woman, but she became
confused on cross-examination and admitted that she did not recall
whether he was there on the night of July 21st or July 22nd, The
State presented a strong case which, in addition to thepositive iden-
