WAGNER, Valentine

Wagner, a 56~year-old white man, was a pposperous farmen who lived
near Skaug, Morrow Co., Ohio. He had previously had difficulties with
Daniel Sheehan who was married to his sister in a dispute over a ditch
and, at that ‘time, Wagner had threatened to kill Sheehan if he dug
the ditch, saying that his only punishment would be to bay a fine, § On
Dec, 18, 1882, he went to Galion and became intoxicated, As he was
returning home, he detoured by his sister's house where he went inside
and began verbally abusing her, Sheehan protested and Wagner told
him that he would shoot him if he Spoke "two words," Sheehan replied
they could settle the matter later and when he did, Wagner drew a re-
volver and shot him twice with one bullet entering just xnm below the
heart. The authorities were notified and Wagner was taken into cus~
tody. Instead of being fined, he was charged with first degree mur-~
der, At his trial, his defense was insanity but:he was convicted and
sentenced to die. His case was appealed to the Ohio Supreme Court
which affirmed the lower court. Wagner's son made every effort to
save his father's life on the grounds of his alleged insanity and a
final plea to the Governor for a commutation of sentence was unsuccess-
ful. On July 31, 1885, Wagner became the first man to be hanged under
& newly pessed law requiring that all executions take place at
