employer and his wife were both away, they would hire a 15-year-old
student, Ruby Ann Payne, to babysit for them and “upp made several

of Aug. 8, 1952, while Miss Payne was staying with his employee's

son to go down to one of the hives and bring up a five gallon bucket

again. When she rejected him, he struck her with a hammer and, as
she ran, he shot her twice in the back with a .22 caliber rifae.
