Mitchell, a Negro born in 1930 in Memphis, Tenn.had a res

cord for armed robbery dating back to his teen years.
He was a classical example of a person paroled to rob

again, having served time in Tennessee, Illinois and Colo-

rado. On the night of Feb, 155° 1963; he was out on bond
in Sacramento, Calif., where he was working as a pants
presser and, in an attempt to raise money to pay his
attorney's fee in a forthcoming trial for armed robbery,
he robbed a swank restaurant and lounge. Police were
notified that a robbery was in process, and when they
afrived, Mitchell elected to resist them. In the shhot-

out, 2-yeare-old Patrolman Arnold Gamble, a 20-year vetera}

of the force was fatally injured while Mitchell was
