Amendola, a 3l-year-old native of Italy, lived in Utica, Ne. Y. On
Febe 3, 1922, he encountered Rocco Fiorillo, an East Utica baker who
he did not know in front of a meat market on the corner of Third Ave,
and Elizabeth Street in Utica and, without visible provocation, drew
a revolver and shot him. Fiorillo ran into the market and collapsed
in a dying condition and Amendola followed and shot him twice more
in the head. He was taken into custody a few hours later at the home
of his common-law wife who subsequently testified that when he had
left the house earlier that day, he had carried a pistol and said
that he had a use for it. There were rumors that Amendola was a KLE
hired assassin for a Black Hand society, but at his trial he would
only say that he had killed Fiorilla because the baker had threatened
him for no reason when their paths crossed. Convicted and sentenced
to die, his attorneys appealed the case unsuccessfully and then
sought executive clemency to no avail, Prior to his death, Amendola
claimed that he had, indeed, been hired to kill Fiorilla but refused
to name the persons who had employed him, He was electrocuted at
