Higgins, a 26-year-old black resident of Harrodsburg, Ky,, had served
one sentence in the Kentucky Prison system, After his release, he
returned to his native Mercer County where he lived with his wife and
two children and had no further conflicts with the law except for one
minor incident when he appeared in a justice of the peace court for
breach of the peace for which.he was fined, A farm laborer, he worked
for various farmers over the county, many of whom lived in the Kirk-
wood area north of Harrodsburg, On the morning of April 7, 1939, he
telephoned the 23-year-old wife of mm a man for whom he had worked
and inquired as to whether or not he was at home, stating that he
wanted to collect some money due him, The wife told him that her
husband was away and would be for the remainder of the day. Around
1l o'clock Higgins appeared at the house and attempted to rape the
woman but she was able to fight him off and he fled, He traveled
about a mile over the fields to the home of a 76-year-old white widow
and, after talking with her for a few minutes about the Bible and
Christianity, hl bound her with rags and a pepe and raped her, The

neighbors and eels of about fifty men who were combing the area in
search for him found the old lady in a serious condition and released
