Brown, a 27-year-old white unemployed glass-blower, lived at 25754
Randolph Sty, Huntington Park, Calif, In October, 1930, he became
acquainted with Emery Ells, manager of a Los Angeles cafe, Fills and
his wife were separated and she had filed suit for divorce, citing
his cruelty as grounds, Ells explained to Brown,wno, desperate for
money, posed as a "hit man", that he would pay him $2,000 to kill
his wife so that he could obtain custody of the baby, He advanced
him $2,20, all in dimes, on which to eat until the job was completed
and provided him with a rusty shotgun, gloves,a flashlight and a re-
volver, On the night of Nov. 1, Brown stole an automobile at gun-
point and early the next morning he went to the home of Mrs, Ells!
sister located at 323 7East 99th St., Los Angeles, where she was
sleeping with the baby on an unlocked sleeping porch in the front

of the house, entered and shot her to death with the shotgun, He
then returned the gloves, flashlight and revolver to Ells who told
him that he would be paid the $2,000 dhortly and abandoned the car
in Huntington Park, Mrs, Ells' body was found the next morningy
lying by the crying baby who had been unhurt by the blast and

Ells was arrested that same day on suspicion, He maintained that he
knew nothing of the murder and continued to do so until Brown who had
