LYONS, Elliott
Lyons, a 35-year-old white man, was a member of a KKAMXAKH respected
Lane County, Oregon, family, At one time he had served as a field
deputy sheriff, making tax caollections, and he was convicted of
having embezzeled some of the money collected and served a one-year
sentence in the State Prison, During the latter part of 1902, he was
arrested in Jackson County for horse theft but managed to escape and
made his way to the home of his parents near Walton, Acopy of the
warrant for his arrest was sent to Sheriff W. W. Withers of Lane Coun-
ty and when Withers learned that Lyons and his wife were at the home
of his parents, he went there on the evening of Feb. 5, 1903, accompa-
nied by a constable and a special deputy, Sheriff Withers went to the
front door of the Lyons home while the other two officers went to the
rear and Withers entered the house and placed Lyons under arrest, His
parents and wife began pleading with him not to arrest Lyons and RK&H
while they were doing so, lyons deew'a pistol and shot Withers through
the neck before fleeing into the darkness. Withers was taken to the
home of a neighbor where he died two days after after making a state-
