THE NEW YORK HERALD, September 22, 1802

"A black boy about 12 years of age belonging to Capt. Fuller in
Harman Street lately purchased six-penny worth of arsenic at the
store of an apothecary for the purpose, as he said, of destroying
rats and pretended that he acted by Capt. Fuller's orders. On Thursday
morning immediately after eating breakfast, Capt. Fuller and his
family were seized with sickness at the stomoch. Without entertaining
any suspicions as to the cause, they prepared a strong herb-tea, which
having drank, the sickness became still more violent. On inquiry it
was discovered that the boy having infused into their breakfast the
small dose of arsenic he had purchased for sixpence and fearing that
the effects were not likely to be sufficiently powerful, had returned
to the apothecary and obtained double the quantity which he contrived
to mix with the herb-tea and that had been prepared as an antidote.
Medical assistance being called in, the usual remedies were applied
and though Capt. Fuller and his family remain in a very distressing
situation, we are given to understand they are all in a fair way of
recovery."

POUGHKEEPSIE NY August 10th; Some days ago a discovery was made
of the villains who in January 1777 forcably en-
tered the lodgings of HEnry Williams Esq. at the house of Henry Dick-
inson in Bedford and robbed him of money, plate, wearing apparel etc.
to a large amount. Five of these robbers, viz. JEREMIAH MERRITT,
THOMAS GREEN, principals, and GILBERT PURDY, JOHN van VESSER, JOHN
SLUTT accomplices, together with Samuel Tilley charged with being
concerned with them in robbing Mr. Benedict, were taken up and
carried before Ebenezer Purdy Esq. who examined and committed them
to Poughkeepsie gaol where they are now secured.

NOTE: These are almost certainly the five unidentified robbers
you list as having been condemned at Albany on Aug. 10th.
Your source ts slightly off with dates and locattons but
essentially correct.

_/ TRENTON NJ Oct.14th; About ten days ago JACOB FAGAN, who having

previously headed a thumber villains in Monmouth
County that had committed divers robberies and were the terror of

the public highway in that county to deter others from perpetrating
the like detestable crimes.

NOTE: What do you make of this one? Was he legally executed by
a firing squad or shot down on the road? The answer could
go etther way.

GLOUCESTER NJ (From a rebel paper) Philadelphia, Sept.9th;

Last Saturday the Court of Oyer & Terminer ended
at Gloucester, West Jersey, when the following prisoners received
sentence of death for high treason, viz. HARRISON WELLS, WILLIAM
HAMMETT, JOHN DILKES, JOSHUA DILKES, PATTERSON COOK, ISAAC LORD,
THOMAS NIGHTINGALE, DAVID LLOYD, GIDEON URINE, ABRAHAM FENNEMORE,
JAMES BIRCH, DANIEL FURMAN, CHARLES STRINGE, LAURENCE COX, JOHN
FRANKLIN, JOSEPH DILL and JOSEPH PRATT. BENJAMIN BARTHOLOMEW also
received sentence of death for burglary. Friday the 29th of January
next is appointed for the day of execution.

GOSHEN NY (From a rebel paper). Fishkill NY June 17th; On
Tuesday the 8th instant JAMES FLUELING, JAMES SMITH,
(son of the noted Claudius Smith), JAMES McCORMICK and DANIEL KEITH
were executed at Goshen for the robberies and murders they have
committed. They appeared to be extremely stupid and impenitent.
Daniel Keith belonged to Burgoyne's troops and left them on their
way to Virginia. He said that he left his corps by the direction
of his ---[illegible]--- with a design to go to New York and this
said officer gave him an order on Lord Reardon for seven [illegible]
He likewise said that the company of robbers with which he joined
were intended as pilots to conduct their friends to New York and
that the British officers at said place approved and countenanced
them in dastardly [illegible] The other three said that they had
heard that Sir Henry Clinton and several of the refugees that he
could countenance and support them in distressing the rebels without
the British state.

Note: A second batch at Goshen NY in 1779. Note in particular that
one was the son of one who was hanged in the first batch.
They were all infamous Tories who terrorized the countryside
with robbertes and murders.

FISHKILL NY Dec.20th; A few days since one JAMES YATES, who
says he was born in Westchester County, was com-
mitted to gaol in Albany for the wilful murder of his wife and four
children. He also killed his cattle. WHEELER and WOOD, two atrocious
villains, received sentence of death the 15th instant for robbing
the house of Cornelius Schermerhorn of Schotock about twelve miles
from Albany and for attempting to murder them. Wood has been a noted
robber since 1776, Wheeler about three years. He confessed he was
concerned in several robberies and appears penitent. Wood is stubborn
and confesses nothing.

NEW JERSEY Feb.6th; On Tuesday the 29th last JAMES MORGAN
was executed at Westfield pursuant to his sentence
for the wilful murder of the Rev. James Caldwell. A sermon upon the

occasion was preached by the Rev. Jonathan Elmer from Jer. XLIV:4
"Oh do not this abominable thing that I hate."

NEW YORK Last Monday a Court was held here at the City Hall for
the trial of piracies by commission grounded on the
statute of King William III. Three prisoners were brought before
the commissioners: two of them natives of Great Britain and one of
Ireland. JOHN CLARK and James Wigmore were found guilty but the
third, Joseph Brown of Bristol, was acquitted and immediately dis-
charged. CLARK is sentenced to be hanged the 28th instant on the
shore near the Air Furnace but it is said Wigmore will be recommended
to His Majesty's pardon. The prisoners had been put on board a prize
to convey her to port for condemnation and were charged with joining
the crew of the prize in rising against the prize-master and running
away with the vessel and cargo which they intended to divide as
spoil among themselves. They had so far accomplished their design
as to be within soundings of the coast of Virginia when the prize
was retaken by two of His Majesty's frigates who sent her with the
criminals to this port. The prize was from Cape Francois and bound
to Amsterdam and was first captured in the West Indies in February
last by a British privateer in which the criminals had entered
Turk's Island for a cruize against His Majesty's enemies. It is
hoped that the justice which has overtaken these convicts will
deter other mariners from a crime punished by all nations with
death: sea robbers being considered as enemies to all mankind.

SARATOGA NY Extract of a letter from Albany dated June 6th:

This day one CANFIELD will be executed at Saratoga
according to the sentence of a General Court Martial. Said Canfield
is a native of Northampton in the Commonwealth of Massachusetts,
deserted from the First New Hampshire Regiment and joined the most
infamous Major Rogers' banditti, came with a party to No. 4 to take
of some intelligence errand and was fortunately taken with four
others. He seems to be a hardened wretch and insensible to his un-
happy state.

RICHMOND VA June 21st; On Saturday last the additional session

of the Honorable General Court ended when the follow-
ing prisoners received sentence of death, viz. HUGH LOGAN from Augusta
for a rape, TIMOTHY CAMPBELL and GEORGE TIEL, wagon drivers in the
French service for horse-stealing, and JAMES LAMB, JOSHUA HAWKINS and
JOHN CATON from Princess Anne for High Treason.

NEW YORK On the 27th of May Mr. WILLIAM STONE was executed at

Hartford in Connecticut for being concerned in enlisting
men for His Majesty's Service. The perpetrators of this murder are
well known.

Note: The location of this execution is an obvious error on the

part of the editor of the New York Weekly Mercury. The exec-
utton of William Stone took place at an upstate New York location
called "Mount Independence". The editors evidently pteked up the
story from a patrtot newspaper dated May 27th. The actual execution
took place on May 8th.

FISHKILL NY July 3lst; Last Monday was hanged at Fort Montgomery
one of Lord Howe's recruiting officers. Last week an-

other of the same gentlemen was hanged at Peekskill.

Note: These two British recruiting officers cannot be tdentifted

by name. The New York newspaper ts quoténg from a Patrtot

newspaper published at Fishkill and dated July 8lst. While I cannot

pinpoint the location of Fort Montgomery, I can say that it was def-

inttely some place in upstate New York.

LANCASTER PA March 18th; (From a rebel newspaper was take the

following); In pursuance of orders from His Excell-
ency the Commander in Cheif, a General Court Martial was held at this
place when HENRY MANSON, (who confessed himself an officer in the
British army), and WENDELL MYER, an inhabitant of this county, were
brought before the court and charged being spies, carrying ona
traitorous correspondence and supplying the enemy with horses, etc.
The court after a fair and candid trial which lasted some days, and
every opportunity given to them to make their defence, found them
guilty and unanimously sentenced them to suffer death. In consequence
of which they were on Monday last executed near this town amidst a
very numerous concourse of spectators. The unhappy wretches before
their execution acknowledged the justice of their sentence and died
fully convinced of the heinousness of their offence.

NEW YORK Seven men were to be executed last week at Poughkeepsie
for several robberies.

NEW YORK (From a rebel newspaper): FISHKILL NY, April 23rd;

On Saturday last the Supreme Court of Dutchess County
State of New York adjourned till the fourth Tuesday in May after
passing sentence of death on the following persons, viz. WILLIAM
SMITH, DANIEL AKELY, SAMUEL JENKINS, MYNDERT HARRIS, DANIEL CORNELL,
------- SIMKINS and ----~——— MORGAN, who are to all be executed to-
morrow at Poughkeepsie.

Note: These might be the seven untdenttfied men you show as having
; been executed at Albany on June Sth.

07-19-1779 POUGHKEEPSIE NY June 28th; We hear from Tryon County that a
certain HENRY HARE, (formerly an inhabitant

of that place and who had joined the enemy under Butler, was found
lurking in a private manner about the army under the command of
General James Clinton in order to gain intelligence of their strength
and situation), was apprehended and hanged for a spy agreeable to
the sentence of a court-martial. He confessed to this having been
the third time to have been in that neighborhood in a private manner |
since joining the enemy and alleged he was a lieutenant under Butler.
He left the Seneca country with 63 Indians but soon after parted
with them to prosecute the base business for which he was executed
and we are informed that the party he came out with proceeded to
the Scotch settlement 30 miles west of Schoharie from whence they

took off 21 of the inhabitants who were cheifly Tories and several
head of cattle.

Note: An Amertcan spy executed by the British at Tryon Co. NY
Thts is upstate WY. -The name ‘Tryon County' was changed
after the revolution in disdain for the hated Royal Gov.
of New York, Sir William Tryon. However I cannot determine
what present-day county was ortgtonally Tryon County. But
tt ts definitely upstate New York.

12-06-1779 PENNSYLVANIA Nov.23rd; | At a court of Oyer & Terminer held at
York-Town for the County of York commencing the

lith of October 1779 before the Hon. Thomas McKarn and William Aug-
ustus Atlee Esquires, NATHANIEL PATTOE and HENRY TROUT were convicted
and condemned to be hanged for passing counterfeit 30 dollar bills
of Continental money of the emissions of 22nd July 1776, knowing it
to be counterfeit. GEORGE FLETCHER was convicted and sentenced to
death for the murder of CHristian Baughman. JAMES BOYD was convicted
and sentenced to death for robbing Thomas Stevenson on the highway.
And THOMAS PEDLY was convicted and sentenced to death for a burglary
in the house of John Folas in York-Town.

05-29-1780 NEW JERSEY We are informed that at Newtown, Sussex County, on
the 16th instant JOHN McCOY and ROBERT MAXWELL, des-

erters from the Convention Troops, were convicted of burglary com-

C mitted in Greenheage; that the Friday ensuing McCOY was executed

p w- and the other respited till the 9th of June next. We are told that
Y G they appeared extremely penitent, expressed confident hopes of sal-

S| { vation and at the place of execution made the most solemn protest-—

D ra ations of their innocence of the accusation for which they were to
- ‘ suffer. The unhappy man died in charity, he said, with all men and
+/ ey. hoped that after his death the world might have due testimony of his

integrity.

NEW JERSEY
07-03-1780 UNSPEGIFIED -LOCATION--~ The three men lately executed at Washing-

ton's camp were JOHN CLAWSON, formerly of
yi Woodbridge, a young man of the name of HUTCHINSON from Morristown and

ss a LUDOVIC LACY of Sussex. There was a fourth person in company when
wy the above three were taken in Mr. Veal's barn but he was shot after
&

| -» he had delivered himself up to the party that came to take him. Mr.
va Veal, in whose barn they were found, was carried to the place of ex-

ecution and would also have been executed but the poor men exculpated
¢ him before they were sent out of the world.

NOTE: I believe this to have been somewhere in Ney Jersey but it will

require checking an atlas of the American Revolution to find out
WHERE WASHINGTON'S CAMP WAS AT THIS TIME.

BUCKS COUNTY PENN. We are informed that a Court of Oyer &

Terminer was lately held at Newtown, Bucks
County, in the Province of Pennsylvania, when JOHN TOMLINSON was
convicted of fearing God and honoring the king, (high treason),
and was executed on the 1/th last.

PHILADELPHIA Feb.15th; We are informed that the criminals
under sentence of death for the robbery of the
house of William Bush Esq. will be executed this morning.

07-17-1780 BALTIMORE June 20th; At a Special Court held at Burlington
last week ROBERT POMEROY was tried for the murder
of David Hurly and convicted on very full evidence. He is sentenced
to be hanged the 7th day of July next.

NOTE: Is this Burlington NJ or some other Burltngton?

11-13-1780 NEW YORK [From a rebel newspaper] Poughkeepsie, Oct. 30th.
On His Excellency's return to Albany, by virtue of

an Act "subjecting all persons who shall come out from the enemy
and secretly lurk in any part of this state to trials by court-
martials as spies", he ordered an General Court Martial for the
trial of JACOB SHELL, JOHN McMULLEN and JAMES van DRIESEN, who were
found guilty and sentenced to be hanged on Friday last. The two
former were executed accordingly and the latter was respited for
a few days. These villains it appears had joined the enemy, were
now in their service, and found lurking about the country as it is
supposed for the purpose of recruiting and obtaining intelligence
for the enemy. As it is probable there may be many more of these
gentry in other parts of the state, it behoves us to be very vigil-
ant in causing them to be apprehended and brought to justice.

01-29-1781 NEW JERSEY Last Thursday was executed at Bird's Point in Bergen
v County and Province of New Jersey pursuant to his

4,
Ae . sentence STEPHEN BALL, a spy. He was very active in the execution
of THOMAS LONG, a refugee from Jersey, who suffered death in that
‘in province in the year 1779. Ball was apprehended on Staten Island by

a party of refugees.

NOTE: Note tn partteular the retrospective mention of a prevtously
unknown New Jersey execution.

08-20-1781 NEW JERSEY Aug.8th; At a Special Court lately held at Burlington

a certain JOSEPH MULLINER of Egg Harbour was convicted
/ of High Treason and is sentenced to be hanged this day. This fellow
u/, had become the terror of that part of the country. He had made a

practice of burning houses, robbing and plundering all who fell in
his way, so that when he came to trial it appeared that the whole
country -- both Whigs and Tories -- were his enemies.

Continuation of THE NEW YORK WEEKLY MERCURY (1777-1783)

05-05-1777 NEW YORK We hear the rebels have lately hanged Mr. GURDON
WINMORE of Hartford on suspicion of aiding the es-
cape of some Tories from that place. And that a man by the name

of MABIE was also lately hanged at Peekskill on supposition of
his being concerned in enlisting men for His Majesty's Service.

Note: This ts difficult to interpret. The alleged Connecttcut

executton of Gurdon Winmore ts otherwise unknown. I strongly sus-

pect that these two are the same as the two untdenttfteds we show |
as having been executed at Peekskill NY on April 20th 1777. The

man named 'Mabte' was almost certainly one of them and 'Winmore'
was probably punished at the camp tn Peekskill for a military
ertme tn Connecticut. As I recall, the source for the two untdent-
tfteds at Peekskill is a mentton thereof in a 19th century htstory
of Dutchess County whtch I sent you recently. The author thereof,

tf I recall correctly, said that they were two 16 year old boys

who deserted thetr colours. As this ts the same author who gave

the badly garbled account of the burning of a white man and negro

together, I suspect that his account of the 16 year old boys is

ltkewtse fudged and that the above are the actual details of this

double executton.

06-09-1777 GOSHEN NY (Orange County) From Orange County we hear that as
Capt. Rose of Marbletown and Lieut.
Middagh of the same place, were coming to this city with a company
of men for His Majesty's Service, they were intercepted on the
road by a party of the rebels. Several of the men were wounded
and the two officers were put into gaol, tried and executed about
a month since.

Note: The executtons of Capt. Rose and Lieut. Middagh at Goshen
‘ f NY appear to be new ones. The story tis quite plausible.
Thetr crime would have been "recruiting for the enemy", a common
capttal offense during thts pertod for which many are known to
have been hanged. I would tentatively date the executions in early
May, 1777 and definitely asstgn them to Goshen NY.

06-09-1777 NEW JERSEY ABRAHAM PATTEN, a spy from the rebel army, was ex-
ecuted at Brunswick last Friday between eleven and
twelve o'clock. He had agreed to give a grenadier 50 guineas to
carry four letters to Washington and Putnam. The soldier took the
cash and carried the letters to His Excellency Lord Cornwallis,
wherein was proposed on a certain day to set fire to Brunswick in
by four places at once, blow up the magazine and then set off a rocket
‘ 0 , _ as a signal for the rebels to attack the town. At the gallows he
\ N acknowledged all the charges brought against him and said he was
LW a principal in setting fire to New York but would not accuse any

of his accomplices. The said Patten formerly lived in this place
and has left a wife and four children at Baltimore in Maryland.
