treme penalty was cormitted on the night of Wednesday, Oct,
ef, 1920, when following his and his companions! escape
from the county jail where they were prisoners on charges
of theft and carrying a pistol they made their way to Har-
wood and brutally attacked an elderly white woman, Mrs,
Theresa Kuntscick who lived alone on her farm, After ass-
aulting and robbing her she was left gagged and bound to
the bedpost. Howard and Nations were captured Nov, 1, near
Hondo, located at a road camp, The death warrant was read
Jan, 15, 1921, in districy court. They were convicted of
rape as charged in indictment, Sentence was pronounced
Jan, 21, 1921 to be hung March 18, 1921, any time after
