HERRERA, Ofilio
Herrera, a Mexican whiskey runner, was driving through Mason Co., Tex.
on July 28, 1929, accompanied by a hitch hiker xis to whom he had
_ given a ride. The Sheriff of Mason County, J&KK Alan T. Murray, had
received a telephone call from a motorist who told him that a bag had
disappeared from his automobile and that he Sim felt that two Mexicans
traveling towards Mason in a Chevrolet coupe had taken it. Shortly
afterwards, Herrera and the other man passed through Mason and Murray
stopped them just outside of town. He searched the car and when he
found between forty and fifty gallons of whiskey in the trunk of the
cary he placed them under arrest. He stood on the ruming board and
told Herrera, who was driving, to turn around on a dirt road, In-~
stead, Hererra pulled the Sheriff's pistol from his holster, drove
up the road and shot and killed the Sheriff, He took Murray's hat
as well as the pistol, drove up the road a piece and buried the hat,
pistol an§ wniskey. He then told the other Mexicen that he had better
