Talbott, a 19 ~year-old white Waitsburg, Washe, had served several
months at the "tate training School at Chehallis 3 following his con-
wiction on a charge of tire theft. In 1938, he was working as a
farm hand during the wheat harvest and met 70-year-old Waitsburg
farmer W. E. McKinney whose crop !albott's employer was harvesting.
Talbott and Moiinney made a verbal agreement for Talbott to purchase
a horse and saddle fret the elderly xmwam rancher for $20, and on the
morning of Auge 9, 1938, Talbott went to the ranch to get the horse.
He and McKinney qent into the xmm machine shed and sat on the back
of a trailer to discuss the matter and McKinney related that his
daughter had asked him not to sell the horse and saddle and he had
decided to abide by her wishes. This infuriated lalbott and he hit
McKinney on the side of the head with a pair of pliers and then shot
him twice in the head. He attempted to pull the trailer down to a
river where he was going to dispose of the body, but lost control and
when the tongue of the wagon struck the ; ground, Mek dtinnsy 5 body was
catapulted from it. Talbott covered the body with some debris, stole
the saddle, a couple of guns and McKinney's ‘automobile and left.
Mckinney's body was discovered later in the day by his brother and an
