Lerma, alias Martin Flores, was a 25<yeareold Mexican-American native
of Texas who had deserted from the U, S, Calvary and was living at
Lackawanna, N, Y, On the night of January 15, 192h, he and an uniden-
tified black man were arrested in Buffalo as suspicious characters by
Detective William Hunt, When Hunt turned his back on his prisoners
to telephone for a patrol wagon, Lerma drew a pistol and AKKHMAKXKE
attempted to shoot him in the back, After the pistol had misfired
three times, Lerma bludgeoned him unconscious with the butt of the
weapon and he and the black man fled, The black man was never cap=
tured, but Lerma was arrested bhortly afterwards in a room at 195
Seneca St. while in the process of cleaning the pistol and said that
he had attacked Hunt because he feared being taken into custody with
the weapon in his possession, Hunt died from his wounds two days
later and Lerma was charged with the murder, At his trial, he repudi-
ated his confession, claiming that the black man was the actual mr-
derer, but eye-witnesses identified him and he was convicted and sen-
tenced to die, The conviction was affirmed by the New York Court of
Appeals without opinion and on January 22, 1925, Lerma was electrocu-
