of Criminal Appeals because the judge had refused to give a defense
reques ted instruction that if he had been forced into participation
in the crimes, he should not be convicted. The higher court affirmed
the conviction and then the Mexican Government made a plea to the
Governor of Texas for clemency, The Governor granted a two-weeks re-
spite for investigation of the case but then declined to intervene
further and both. were electrocuted at the Texas State Prison on Sept.
7, 1928. They went to their deaths calmly and the last words spoken
by each was a protestation of innocence, Rodriguez entered the death's
chamber first and just before being seated in the chair, took a long ae

1927, they accosted arg a young man and his high-school date who
were driving on the streets of San Antonio, They leaped onto the
sideboard of the car and Rodriguez drew a pistol and forced the
young man to drive to some brush where they tied his hands behind
his back and forced him and the girl into the back seat. XMEXXEKEK
Servina covered the couple with the gun while Rodriguez drove the
car to a deserted area seventeen miles from town, Rodriguez forced
the man out into a field while Servina robbed the girl and raped
here Rodriguez then returned to the car and attacked the girl.
After each had raped her twice, they drove her back to within seven

bound and gagged, After she managed to free herself, she walked
