Roberts, a white man, left the Black Hills with Howard or Harry I,
Morris, alias Goudy, in the Fall of 1877 to travel to Montana, For a
few days they traveled with a small pack train on the old Fort Phil
Kearney Road and after they left the train they were last seen toge-
ther on the Big Horn, A few days later a man found the nearly nude
body of Morris, bludgeoned to death, buried in a nearby grave and
Roberts was arrested a few days later on suspicion and taken to a
military camp near McAdow's Mill, ‘When questioned as to the where-
abouts of his partner, he first said that Morris had gone prospecting
and then told other conflicting stories before he finally admitted
that he had killed Morris, He said that they had quarreled and then
fought a fight from which Morris had emerged the victor, He said
that Morris had drawn axpistol and threatened to kill him and that
