Hacker, a \9-year-old white man, resided in Montgomery Co., Ne. Y,
On one occasion, he had lost a law suit to Thomas EH, Burdick, a
prominent and respected citizen of Ephrata. On several occasions,
when drinking, Hacker had threatened to kill Burdick as a result
of this litigation, but Burdick ignored him. On July 4, 1870, Bur-
dick read the Declaration of Independence at a celebration at Ste
Johnsville, That night,there was a "hop and sing" dance at a St,
Johnsville Hotel which Burdick attended with his wife and children,

of water for one of his daughters, and when Burdick stopped to speak
to a friend, Hacker drew a revolver and shot him, inflicting a mortal
wound, Hacker was promptly arrested, even though he protested his
innocence and claimed that the shot had been fired by someone else
in the crowded bar room, Tried, convicted and sentenced to die, he
