“Nichols, a ofmyecar-old black man, worked as a tenant farmer in the
lower portion of Travis County, Texas, Around 5 o'clock on the after-
noon of March 31, 1893, he was phowing in a field bordering on the
Cedar Creek Road when he noticed ll-year=old Annie Straka, a Bohemian

_girl who had emigrated to the United States with her parents three

/years previously and was unable to speak English, wakking to her home

following a visit to the residence of an uncle, Nichols followed and

| overtook her at a wooded hollow into which he dragged her and forcibly
\raped her, As she was to undeveloped for him toPaccomplish his pur-
pose, he used his hands to tear her sexual organs and effect penetra-
‘tion, After he had left, the critically wounded girl crawled 3/li's of
a mile through some brush in an effort to reach home and fell exhausted
in her father's field where he found her shortly afterwards, Officers
trailed Nichols from the scene of the assault to a water-hole where he
had knelt and washed his hands. He was arrested shortly afterwards
and his handprints were found to match those at the waterhole and mud
on his boots matched the mud there, The front of his clothing was
bloodshained and Miss Straka positively identified him when he was

brought before her, At his trial, he offered an alibi, claiming that

he had not left the field where he was plowing, but it was unsubstantia4
ted and he was convicted and sentenced to die, The case was unsuccess~
