they were surrounded, they surrendered, . Both maintained that they
had killed nobody and that they dead Walters had shot both Hartye and
Fagan, A fourth man in addition to xime Walters, Hartye and Fagan

was a victim of the escape when McGovern Miller, an elderly patient
in the hospital died from a heart attack induced by the excitement,
Convicted and sentenced to die, both were electrocuted at Sing Sing

on June ll, 1912,

McGale, 2-years-old, and Riordan, 2h-years-old, were both white in-
mates of Sing Sing Prison, McGale had received a 15 year sentence
for rogbery in Manhattan in 1936 while Riordan and 30-year-old John
Waters had been sentenced to terms of from 15 to 30 years for parti-
cipation in a 1939 holdup of the Consolidated Editon Company in Man-
hattan which had netted $10,227. McGale had worked in various places
in the prison before being assigned to the ice house and he knew of
a small tunnel, barely lakge enough to permit passage, through which
steam pipes and cables were carried into the prison, The three con-
victs made contact with two men on the outside who attached three re
volvers and three sets of handcuffs to the rear axle of a milk truck
which made deliveries to the prison on March 22, 191, McGale, who
had access to the truck, discovered the contraband and hid it wtil
he and Riordan managed to get admitted to the prison hospital where
Waters worked by feigning illness. At 2:05 on the morning of April
1h, while other inmates were sleeping, they pounced on 67-year-old
John Hartye, a veteran of 18 years as a guard, and shot him in the
