Dear Chairman J ensen,

| want to commend you for your leadership during past legislative sessions,
especially in your work with Representative Tilley to craft a bi-partisan bill to
begin significant reform of our penal code. We need more efforts like this in
Kentucky!

As you go forward with your penal code reform efforts, | urge you and Rep-
resentative Tilley to incorporate the exclusion of execution as a punishment
for defendants whom the court determines are severely mentally ill.

| certainly agree that persons suffering from severe mental illness at the
time a capital crime is committed should be held accountable. Because of
their diminished capacity, however, they should not face execution. Life
without parole certainly punishes them and protects us.

Senator J ensen, please support and give a hearing in your committee to
legislation that would exclude the death penalty for severely mentally ill
persons. Thank you for your leadership.
