Felony Sex Offenses in Kentucky
Felony Sex Offenses as listed in KRS 17.500(8), the Sex Offender Registration
statute:
“Sex crime” means: (a) A felony offense defined in KRS Chapter 510, or KRS
530.020, 530.064(1)(a), 531.310, or 531.320; (b) A felony attempt to commit a
felony offense specified in paragraph (a) of this subsection.
That would include:
510.040, Rape 1", Class B, if victim under 12 or serious physical injury then
Class A
510.050, Rape 2", Class C
510.060, Rape 3", Class D
510.070, Sodomy 1%, Class B, if victim under 12 or serious physical injury
then Class A
510.080, Sodomy 2", Class C
510.090, Sodomy 3%, Class D
510.110, Sexual Abuse 1°, Class D, if victim under 12 then Class C
510.148, Indecent Exposure 1“, Class D for third offense if committed
within 3 years of second offense and for any offense subsequent to 3
offense within 3 years
510.155, Unlawful Use of Electronic Means to Induce a Minor to Engage in
Sexual Activity, Class D
530.020, Incest, Class A if victim under 12 or serious physical injury, Class B
if forcible compulsion, less than 18 or incapable of consent, Class C if
between consenting adults
530.064(1)(a), Unlawful Transaction with a Minor 1*, Illegal Sexual Activity,
Class A if physical injury, Class B if victim under 16, Class C if victim under 18
531.310, Use of a Minor in a Sexual Performance, Class A if physical injury,
Class B if victim under 16, Class C if victim under 18
531.320, Promoting Sexual Performance by a Minor, Class A if physical
injury, Class B if victim under 16, Class C if victim under 18
KRS 532.043, the 5-year postincarceration statute, includes all of the above but
also adds:
¢ 529.100, Human Trafficking, 532.043 requires that it be commercial sexual
trafficking, Class C, Class B if serious physical injury, one level higher if
victim under 18
