Amendment RE: Composition of the Council of Promotions and Continuing Appointments
IT IS HEREBY PROPOSED THAT THE FOLLOWING BE ADOPTED:

That the proposed amendment to the University Senate Charter below be adopted.
•
That this amendment go into effect immediately following Senate approval.

Current Charter:
X.7. Council on Promotions and Continuing Appointments
X.7.1. Composition
X.7.1.1. At least eight and no more than twelve Teaching Faculty (of whom at least four
must be Senators), from a balance of academic disciplines including the library.
X.7.1.2. One Professional Faculty member
X.7.1.3. One graduate student, who must be a Senator
X.7.1.4. One undergraduate student, who must be a Senator
X.7.1.5. No more than 2 voting members selected from Faculty or Staff who are students
or Voting Faculty
Proposed Revision:
The following changes (in bold) are required to sections preceding Section X.7.1.6.:
X.7.1.1. At least eleven and no more than fifteen Teaching Faculty (of whom at least four
must be Senators), from a balance of academic disciplines including the library.
X.7.1.2. One Professional Faculty member
X.7.1.3. One graduate student, who must be a Senator
X.7.1.4. One undergraduate student, who must be a Senator
X.7.1.5. No more than 2 voting members selected from Faculty or Staff who are students
or Voting Faculty
Rationale:
On September 25, 2013, UAlbany Local Chapter UUP President, Bret Benjamin, requested that the
Senate review the composition of the Council on Promotion and Continuing Appointment (CPCA) in
light of the current contractual agreement between State and UUP. The Governance
Council reviewed the applicable provisions of the University Senate Charter (X.7.1) which defines the
composition of the CPCA to include, in addition to Teaching Faculty, one Professional faculty
member, one undergraduate student and one graduate student. Based upon that review, the
Governance Council concluded that given the CPCA’s responsibility for the determination of a faculty
member’s eligibility and suitability for promotion and continuing appointment and the criteria against
which such a determination is made, the CPCA’s membership should appropriately be limited to
Teaching Faculty.
UUP Agreement and SUNY Board of Trustees Policy References
Article 33.1.c of the UUP Agreement:
“Subsequent academic review” shall mean a review and recommendation by a committee
of academic employees at the division, school, college or other academic employee
organizational level next higher than the initial academic review committee which may
exist for the purposes of evaluating an academic employee for continuing appointment.”
SUNY Board of Trustees Policy - Article II.1.m:
“Academic Employee.” Academic employee shall mean an employee in the Professional
Services Negotiating Unit with academic or qualified academic rank.
