AGREEMENT FOR DUAL ADMISSION PROGRAM
in
EMERGENCY PREPAREDNESS, HOMELAND SECURITY AND CYBERSECURITY
between the
UNIVERSITY AT ALBANY, STATE UNIVERSITY OF NEW YORK
and
MOHAWK VALLEY COMMUNITY COLLEGE
THIS AGREEMENT for a Dual Admission Program, by and between Mohawk Valley Community College (hereinafter “MVCC”), with a
campus located at 1101 Sherman Drive, Utica, New York 13501 and at 1101 Floyd Avenue, Rome, New York 13440, and the State University of
New York on behalf of the University at Albany (hercinafter “UAlbany”), with a campus located at 1400 Washington Avenue, Albany, New York
12222 and its College of Emergency Preparedness, Homeland Security and Cybersecurity being located in Richardson Hall, Room 290, 135 Western
Avenue, Albany, New York 12222,
WHEREAS, MVCC seeks to establish an academic program to allow its students to take a prescribed sequence of courses leading to an associate’s
degree and then to continue their studies at a baccalaureate degree granting educational institution with assurance that the students are on an
academic pathway to a baccalaureate degree in Emergency Preparedness, Homeland Security and Cybersecurity; and
WHEREAS, UAlbany offers a baccalaureate degree in Emergency Preparedness, Homeland Security and Cybersecurity through its College of
Emergency Preparedness, Homeland Security and Cybersecurity; and
WHEREAS, MVCC and UAlbany jointly and cooperatively want to create an innovative dual admission program, drawing on the academic
strengths of each institution, to allow MVCC students to carn an associate’s degree and then transfer to UAlbany to earn a baccalaureate degree in
Emergency Preparedness, Homeland Security and Cybersecurity through its College of Emergency Preparedness, Homeland Security and
Cybersecurity; and
NOW, therefore, this Agreement of Dual Admission Program in Emergency Preparedness, Homeland Security and Cybersecurity (hereinafter
“Agreement” establishes the terms under which students may earn the respective degrees from MVCC and. UAlbany.
Degrees Awarded:
1) MVCC and UAlbany will each award its respective degree to the students participating in this Dual Admission Program. The degrees
shall be awarded in accordance with graduation policies and customs of each respective institution.
Admissions:
1) The dual admission program as sct forth in this Agreement is open to MVCC students who will be entering MVCC as freshmen who have
completed the requisite academic work at MVCC per the parameters of the dual admission program as set forth on Exhibit B, attached
hereto and made a part hereof.
2) MVCC shall be responsible for the selection of students to be enrolled in this dual admission program in accordance with its admission
standards, and UAlbany’s admission standards to maintain academic standing in the dual admission program, all students shall take the
requisite courses as set forth in Exhibit A, attached hereto and made a part hereof, and maintain the requisite grades and grade point
averages as set forth in the policies of each institution as required of all matriculating students of such institution, and as set forth in Exhibit
C, attached hereto and made a part hereof.
3) To matriculate to UAlbany, a student must achieve a minimum GPA of 2.5 at MVCC, provide UAlbany with a final high school transcript
and a final transcript from MVCC, which must post the degree awarded and the final cumulative GPA.
4) Upon completion of the requisite academic work and the achievement of the minimum GPA requirement, a student shal] matriculate to
UAlbany. All matriculation confirmation letters shall be sent by MVCC and UAlbany jointly to the students.
5) A student admitted to UAlbany will have access to early registration at UAlbany during the term prior to his/her initial enrollment if the
student has submitted the Intent to Enroll Form to UAlbany.
6) Upon completion of the associate’s degree, a student will be given credit for meeting the SUNY General Education requirements. Ifa
student completes an Applied Associates of Science Degree, the student will be required to complete any unfinished SUNY General
Education requirements prior to degree completion at UAlbany.
7) Allstudents will be required to take UAlbany’s local general education requirement, Challenges of the 21" Century. This requirement will
be satisfied by the successful completion of CECH 101, Introduction to Emergency Preparedness, Homeland Security and Cybersecurity.
8) Students are eligible to transfer up to forty (40) hours of Experiential Training requirement of trainings completed prior to matriculation at
UAlbany.
9) All admitted students must attend the Transfer Student Orientation provided by UAlbany prior to enrollment at UAlbany.
Number of Students Accepted:
1) No more than twenty (20) students from MVCC shall be accepted for any given academic year at the UAlbany, unless otherwise agreed to
mutually in writing by MVCC and UAlbany.
Appointment of Dual Admission Program Coordinators:
1) Each institution shall appoint a high level administrator, as well as a faculty or staff person, to coordinate and oversee the dual admission
program for the respective institution. The coordinators will work with appropriate faculty and staff and their respective institutions to
help coordinate and communicate the curriculum each year, support the academic advising of students, support the financial aid advising
of students, monitor the progress of students, and cooperate and collaborate with each other when problems or issues arise. The
coordinators will communicate with one another regularly to be sure that the dual diploma program is organized and administered in such
a way that students can meet the requirements efficiently. Long distance advising, principally through electronic communication, will
take place to facilitate the students’ transitions between the two institutions.
Administrative Procedures:
1) MVCC and UAlbany shall establish administrative procedures to facilitate the coordination of all aspects of the dual admission program.
Administrative support shall be put in place within both institutions to facilitate that all arrangements are in place for a smooth transfer of
students, including, but not limited to, academic advising, housing, financial aid and general campus orientation for the students upon
their arrival.
Tuition and Fees:
1) All tuition, room, board and other fees charged by MVCC for enrollment and attendance at MVCC shall be paid directly to MVCC by the
students. All tuition, room, board and other fees charged by UAlbany for enrollment and attendance at UAlbany shall be paid directly to
UAlbany by the students. The setting, billing, collection and refund of tuition, room, board and other fees, including all applicable
policies governing of such tuition, room, board and other fees, are in the exclusive control of each institution respectively, and students
shall be bound by such while enrolled and attending the particular institution.
2) Students shall also be responsible for paying all other costs of attendance at MVCC and UAlbany, including, but not limited to, travel,
books, computers, supplies, medical insurance and treatment, vaccinations, personal expenses, and any other expense(s) incurred by the
students to participate in this dual admission program.
3) No monetary consideration will be exchanged between the two institutions, nor there be any indemnities, reimbursements for expenses, or
sharing of fees or profits arising from the dual admission program, except as provided for specifically in this Agreement or any
amendments thereto.
Housing:
1) On campus housing at UAlbany is guaranteed for students who submit the Intent-to-Enroll form and pay their housing deposit by July 15°
to UAlbany for the fall semester and December 1“ for the spring semester. The students will be placed in housing on Alumni Quad.
Student Health Insurance:
1) Students attending UAlbany shall be required to enroll in the mandatory health insurance program of the State University of New York at
their expense. Students will have access to all student health services, including, but not limited to, the Student Health Services Center
and the Counseling Center.
MVCC and UAlbany Policies and Regulations:
1.
Students while enrolled at MVCC are MVCC students, not UAlbany students, and therefore the students are subject to all MVCC
regulations and policies, including, but not limited to policies on academic standing and student conduct, as amended from time to time. Any
student discipline, including suspension or termination of a student from MVCC, shall be at the discretion of MVCC in accordance with its
student policies and procedures. However, MVCC shall notify UAlbany of the discipline; UAlbany, in its sole discretion, may deny or
revoke a student’s admission/transfer to study at UAlbany based upon the discipline or it may, in its sole discretion, place certain academic
and behavioral conditions upon the student for admission/transfer to study at UAlbany.
Students while enrolled at MVCC are MVCC students, subject to all the rights and privileges of such students, including access to academic
buildings, libraries, labs, student organizations and clubs, sports facilities, and other services offered to MVCC students.
Students while enrolled at UAlbany are UAlbany students, and therefore the students are subject to all UAlbany regulations and policies,
including, but not limited to policies on academic standing and student conduct, as amended from time to time. Any student discipline,
including suspension or termination of a student from UAlbany, shall be at the discretion of UAlbany in accordance with its student policies
and procedures. However, UAlbany shall notify MVCC of the discipline.
Students while enrolled at UAlbany are UAlbany students, subject to all the rights and privileges of such students, including access to
academic buildings, libraries, labs, student organizations and clubs, sports facilities, and other services offered to UAlbany students.
Evaluation of Dual Admission Program:
1) MVCC and UAlbany will establish a protocol to evaluate the dual admission program on an annual basis. Both MVCC and UAlbany
agree to work collegially to identify solutions to programmatic and process problems, and to make improvements to ensure that they
cooperatively offer efficient and quality program to students.
Cooperative Marketing of the Dual diploma program:
1) MVCC and UAlbany shall work together to create a cooperative marketing campaign with joint marketing materials, including, but not
limited to, brochures and website links, and to organize events, including but not limited to, open houses for students and parents to assist
in the recruitment of students to this dual diploma program.
2) In creating and carrying out the cooperative marketing as set forth in the paragraph above, neither party shall identify the other in any
marketing, advertising or other promotional materials to be disseminated to the public or to use the name of either party’s trademark,
service mark, symbol, nickname or logo of either party, without the prior written consent of the other party’s authorized representative or
agent, except to identity the existence of this Agreement and the nature of the cooperative relationship between MVCC and UAIbany in
offering this dual diploma program.
FERPA and Educational Records:
1) While students are enrolled at each respective institution, each institution shall have the obligation of notifying the students currently
studying on its campus, that the institutions are cooperating in the coordination of all aspects of the dual diploma program, including, but
not limited to, the awarding the dual degree, the planning of the curriculum, the academic advisement of students, the orientation of
students, the tracking of students’ successes and problems, and the evaluation of the dual diploma program, and that such cooperation in
the offering and administration of a dual diploma program will require the exchange of certain student information from their educational
records by and between MVCC and UAlbany. Before such records are released and/or shared, that institution shall obtain permission for
such release and sharing from each student, as is required by FERPA, the Family Educational Rights and Privacy Act of 1974, as
amended.
Liability of Each Educational Institution:
1) Neither MVCC nor UAlbany shall be responsible for the acts of the other or for the acts of any student participating in this program.
2) MVCC agrees to indemnify and hold harmless UAlbany from any and all claims by students, their parents, survivors, heirs, executors,
administrators, agents or assigns, arising from any negligent acts or omission on the part of MVCC, its officers, employees, agents and/or
servants.
3) Subject to the availability of lawful appropriations and consistent with Section 8 of the State Court of Claims Act, UAlbany shall hold
MVCC harmless from and indemnify it for any final judgment of a court of competent jurisdiction to the extent attributable to the
negligence of UAlbany or of its officers or employees when acting within the course and scope of their employment.
Force Majeure:
1) In the event that the performance of the obligations under this Agreement is prevented by reasons of Force Majeure, the parties are
released from their obligations and neither party shall be responsible for any damages sustained and shall have no further recourse against
the other party. Force Majeure shall mean fire, earthquake, hurricane, flood, act of God, natural disasters, epidemic, pandemics, nuclear
explosions, strikes, work stoppages, or other labor disturbances, riots or civil commotions, war or other act of any foreign nation,
terrorism, power of government, or governmental agency or authority, or any other cause or like or unlike any cause mentioned which is
beyond the control of the parties.
Term and Termination of this Agreement:
1) This Agreement of Cooperation and Exchange shall be in effect for the period of November 1, 2016 through October 31, 2021, and may
be or extended in writing upon mutual agreement of both parties for additional five (5) year terms.
2) Either party may terminate this agreement at any time with or without cause upon six (6) months written notice to the other party.
Students currently then accepted to or enrolled. in the dual admission program shall be allowed to complete the program for the award of
the baccalaureate degree.
Amendment:
1) This Agreement may only be amended upon mutual consent of both parties, in writing and signed by both parties.

General Anti-Discrimination Provision:
1) Both institutions shall offer all students enrolled in this dual diploma program full access to any activity sanctioned by this Agreement
without regard to race, color, ethnicity, sex, religion, age, disability, marital status, sexual orientation, national origin, marital status,
military status or veteran status.
IN WITNESS WHEREOF, the parties hereby execute this Agreement by their respective authorized signatories on the day and year as stated below
to bind themselves fo this Agreement.
